RETURN AND WARRANTY POLICY

HOME DELIVERY

At SoyMomo we are committed to meeting delivery deadlines, however, due to the situation facing the country because of COVID-19, our shipments may take a longer period than usual, depending on the destination. If your shipment is expected to take more than 7 days, we will contact you. Shipments are managed by courier companies, these may have involuntary delays, at any rate all our shipments are covered in case of logistical incidents.

IN-STORE PICKUP

SoyMomo in-store withdrawals in the Providencia district will be available as long as the district is not affected by quarantine. If the commune of Providencia were under quarantine restriction, the store will be closed, for more details you can contact us by chat on our website or send your questions to contacto@soymomo.com, we will be happy to help you. On the products page you can check if the shipments and withdrawals will be carried out in the near future, always including the shipping date, after that date withdrawals can be made in store. If you have any questions, please do not hesitate to contact us.

RETURNS & EXCHANGES

At SoyMomo we care that our products meet quality standards, so ensure that all products go through this control. In the case you may have any problem with your purchase, all our products have a 3-month warranty from the date of purchase. Therefore, if the product presents a problem, please contact our customer service team contacto@soymomo.com. SoyMomo is governed by consumer laws and guarantees, however returns are not accepted due to customer withdrawal on used products, opened or if their warranty seals are removed. We do not adhere to the right of purchase withdrawal within the first 10 days. If the product you want to exchange or return is completely new and with its seals intact, contact us to help you.

RETURNS MANAGEMENT

Metropolitan Region: In the event of a manufacturing failure in any of our products, please visit our store to carry out the respective review, change or return of your equipment. You may also contact us directly through the email contacto@soymomo.com so that we are able to provide you with the best care.

Regions: In the event of a manufacturing failure in any of our products, please contact our customer service team directly at contacto@soymomo.com; where you will be asked for your purchase data and proof of the failure to offer a solution.

LIMITED PRODUCT WARRANTY

SoyMomo guarantees to the original purchaser that its SoyMomo brand device and its SoyMomo brand accessories (collectively, the "Product") will be free from defects in materials and workmanship under normal use for a period of three (3) months from the date of purchase, except if you reside in the European Economic Area (EEA) and purchased your SoyMomo product in the EEA, in which case, the warranty period is two (2) years from the date purchase (hereinafter, the "Warranty Period").

MEASURES

If a defect appears and SoyMomo receives a request for a return within the relevant Warranty Period, SoyMomo will offer you, as provided by law, three options, product repair (1), exchange for a new product (2), money back (3). In the event of a defect, to the extent permitted by law, these are the only and exclusive measures that you may take. Shipping and handling charges may apply except where prohibited by applicable law. This Limited Product Warranty is valid only in the jurisdictions where the Products are sold by SoyMomo itself or through an authorized dealer or agent, and is valid to the extent permitted by the applicable laws of those jurisdictions. Any replacement product will be warranted for the remainder of the original warranty or for a period of thirty (30) days (whichever is longer), or for any additional period of time required by applicable law.

HOW TO BENEFIT FROM THE WARRANTY SERVICE

To benefit from warranty service, a return authorization must be requested from our customer service team. To request a return authorization, contact the customer service department at contacto@soymomo.com. The return authorization number must be included with the product you are returning. You must deliver the Product, in its original packaging or in a packaging that provides the same level of protection, to the address specified by SoyMomo. As required by applicable law, SoyMomo may ask you to provide details of proof of purchase and/or fulfill other requirements before benefiting from warranty service. It is your responsibility to make a backup copy of any data, software or other materials that you may have stored or saved on the Product. Such data, software or other materials are likely to be lost or reformatted during the service, and SoyMomo will not be liable for any such loss.

EXCLUSIONS AND LIMITATIONS

SoyMomo does not guarantee that the operation of the Product will be uninterrupted or without errors. The Limited Product Warranty does not cover the software embedded in the Product and related services provided by SoyMomo.

The Limited Product Warranty only applies to the original purchaser of the Product that was purchased from an authorized dealer or sales channel and manufactured by or for SoyMomo, which can be identified by a trademark, trade name or logo of “SoyMomo ” located on the product. Notwithstanding the foregoing, the Limited Product Warranty does not apply to any (a) SoyMomo services or products other than the Products, (b) non-SoyMomo products, even if they are included or sold with a Product , including, but not limited to, any counterfeit product, (c) product that is, or reasonably believed by SoyMomo to be, stolen, (d) consumables (such as batteries), or (e) software, even if packaged either sold with the Product or is integrated into the Product. The Limited Product Warranty does not apply to products with the “Made for SoyMomo” or “Works with SoyMomo” logos. For problems or maintenance questions related to these products, contact the manufacturer.

This warranty does not apply to a product or parts of a product that have been repaired, altered, restored or modified by someone not authorized by SoyMomo, nor does it apply to any cosmetic damage such as scratches and dents. Additionally, this limited product warranty does not apply to damage or defects resulting from (a) use with non-SoyMomo products; (b) accident, abuse, misuse, faulty handling, flood, fire, earthquake or other external causes; (c) normal wear and tear or aging of the Product such as discoloration or elongation; or (d) use of the Product (i) outside of the uses for which it is intended or permitted by SoyMomo, (ii) without being in accordance with the instructions provided by SoyMomo, or (iii) with an inappropriate voltage or power supply .

No SoyMomo reseller, distributor, agent, or employee is authorized to make any modification, extension, or addition to this Limited Product Warranty. If any term in this document is considered illegal or unenforceable, the legality or applicability of the rest of the terms will not be affected or harmed.

IMPLIED WARRANTIES

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES (INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) WILL BE LIMITED IN DURATION TO THE DURATION OF THE LIMITED WARRANTY. Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

APPLICABLE LEGISLATION

The Limited Warranty will be governed by the laws of CHILE or EUROPE, depending on your place of purchase, without any conflict of laws principle having effect that could allow the application of the legislation of another jurisdiction.

NATIONAL LEGAL RIGHTS

CONSUMERS IN SOME JURISDICTIONS MAY HAVE LEGAL RIGHTS UNDER THE APPLICABLE NATIONAL LEGISLATION GOVERNING THE SALE OF CONSUMER GOODS, INCLUDING WITHOUT LIMITATION, THE NATIONAL LAWS IMPLEMENTING DIRECTIVE 1999/44 / EC. THESE RIGHTS ARE NOT AFFECTED BY THE WARRANTIES IN THIS LIMITED WARRANTY.
